Terms of Use

These terms are an agreement between you and Pawel Laszczak PawelosFPV, a sole trader (jednoosobowa działalność gospodarcza) registered in Poland (NIP 6812118189) with a business address at al. Solidarności 68/121, 00-240 Warszawa (“Grainy,” “we,” “us”), for your use of grainyapp.com (the “Site”). By using the Site or joining our waitlist, you agree to these terms. If you don’t agree, please don’t use the Site.

1. Who can use the Site

You may browse the Site where it is lawful to do so. To join the waitlist, you must be at least 16 years old. If you are 16 or older but are not old enough to accept these terms where you live, you must have permission from your parent or legal guardian.

2. What the Site is

The Site is an informational page about Grainy, an instant-camera app currently in development, and a way to join the waitlist. Any features, films, prices (such as “free” tiers or in-app purchases), and release dates described on the Site are for information only, are still in progress, and may change or be discontinued at any time. Nothing on the Site is a binding offer, promise of availability, or guarantee that the app will be released.

3. The waitlist & emails

When you join the waitlist, you consent to receiving one email when Grainy opens. We will not use that consent for product updates, newsletters, unrelated marketing, or additional promotional emails.

You can withdraw before the email is sent by using the waitlist withdrawal link or emailing support@pawelos.com. The launch email will also include an unsubscribe link. How we handle your email and consent record is described in our Privacy Policy.

4. Electronic-service terms

Service and technical requirements. The electronic service provided on the Site is access to the Site and the ability to submit an email address to the waitlist. You need an internet connection, a current web browser that supports HTTPS, and, to join the waitlist, a valid email address you are entitled to use. JavaScript improves the inline form experience but is not required to submit the form. Standard internet risks include malicious software, phishing, and attempts by third parties to gain unauthorized access; you should keep your browser and device security up to date.

Formation and termination. Your waitlist service begins when the Site confirms that your submission was successful. You may end it at any time by withdrawing as described above. It also ends when we remove your address after sending the launch email, or if we discontinue the Site or waitlist. The service is free of charge.

You must not submit unlawful content or use the Site to transmit malware or other harmful material.

5. Complaints

You may make a complaint about the Site or waitlist by emailing support@pawelos.com. Please include the email address used for the waitlist, if relevant, and a clear description of the issue. We will acknowledge and respond to the complaint without undue delay and no later than 14 calendar days after receiving it. This procedure does not limit any mandatory consumer or data-protection rights.

6. Grainy Membership

Grainy Membership is an auto-renewing subscription in the Grainy iOS app. A membership unlocks all four cameras and unlimited shots. Without a membership, you get 3 free shots to try the app; that free taster needs no subscription and no payment.

Plans and pricing. Membership is offered as a monthly plan ($3.99/month) or a yearly plan ($19.99/year). Prices may vary by region and can change over time; the App Store always shows you the exact price in your local currency before you confirm, and no charge is made until you confirm.

Free trial. The yearly plan starts with a 3-day free trial for new subscribers. If you don’t cancel before the trial ends, billing begins automatically at the end of the trial. You can cancel any time during the trial to avoid being charged.

Auto-renewal. Your subscription renews automatically for the same period, at the then-current price, unless you cancel at least 24 hours before the current period ends. You can manage or cancel your subscription any time in your Apple ID subscription settings. Deleting the app does not cancel a subscription; you must cancel through Apple.

Payments and refunds. Payment is charged to your Apple Account, and Apple (not Grainy) handles billing, renewals, cancellations, and refunds under Apple’s standard policies. Because Apple processes the payment, Grainy cannot issue refunds directly; any refund request is subject to Apple’s terms.

7. Intellectual property

The Site and its contents, including the “Grainy” name and logo, text, graphics, film-print images, layout, and code, are owned by us or our licensors and are protected by intellectual-property laws. You may view the Site for your own personal use, but you may not copy, reproduce, distribute, or create derivative works from it without our permission.

Any third-party product names mentioned on the Site belong to their respective owners. Grainy is an independent product and is not affiliated with, sponsored by, or endorsed by any camera or film manufacturer.

8. Acceptable use

When using the Site, you agree not to:

• use it for any unlawful purpose or in breach of these terms;
• submit false information or someone else’s email address without permission;
• attempt to disrupt, overload, hack, or gain unauthorized access to the Site or its systems;
• scrape, harvest, or collect data from the Site by automated means without our permission.

9. Third-party links

The Site links to third-party services (such as TikTok, Instagram, and X). We don’t control those sites and aren’t responsible for their content, policies, or practices. Visiting them is at your own risk and subject to their terms.

10. Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don’t warrant that the Site will be uninterrupted, error-free, or that any information on it is complete, accurate, or current.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Site. Nothing in these terms limits any liability that cannot be limited under applicable law.

12. Changes to these terms

We may update these terms from time to time. We’ll post the new version here and update the “Last updated” date. By continuing to use the Site after changes take effect, you accept the updated terms.

13. Governing law

These terms are governed by the laws of Poland, without regard to conflict-of-laws rules, and any disputes will be handled by the courts of Poland, unless mandatory law where you live provides otherwise.
